Case Summary:

Hyatt Corporation is now settling a class action alleging it took biometrics from employees and used them for timekeeping purposes without complying with the requirements of the Illinois Biometric Information Privacy Act (BIPA). Illinois passed BIPA to impose some basic rules on private businesses who wish to collect, store, or use biometrics, and the complaint alleged that Hyatt did not comply with them.

You may be eligible if, during the applicable class period for your location, (1) you scanned your finger using Hyatt’s timekeeping system while working for Hyatt, and (2) you were not subject to a collective bargaining agreement with Hyatt for the entire class period for your location, or you were subject to a collective bargaining agreement for only a portion of that class period. The class periods for the different locations are as follows:

- For the Hyatt Lodge: October 30, 2012-February 16, 2018
- For the Hyatt Regency McCormick Place: October 30, 2012-December 12, 2018
- For the Park Hyatt Chicago: October 30, 2012-December 16, 2018
- For the Hyatt Regency O’Hare: October 30, 2012-December 31, 2017
- For the Hyatt Regency Chicago: October 30, 2012-December 3, 2018

Typical Settlement Amount:

Estimated at $1,500. Final amount will depend on a number of factors, including the number of valid claim forms submitted. Class members may submit only one claim form, regardless of the number of times they scanned their fingers.
