No proof or Claim Form is needed if you received a Notice with a subclass designation on the mailing envelope. If you did not receive a Notice addressed to you at an HHDC property with your subclass designation on the envelope, you will need to provide proof of tenancy. You will also need to submit a Claim Form if you moved from an HHDC property after Februrary 16, 2021.Eligibility:
You may be eligible if you are a member of Subclass A, Subclass B, or Subclass C, as defined below. A list of properties for each subclass can be found in the Notice, pages 4 and 5, at https://hhdcsettlement.com/documents/HHDC-DetailedNotice.pdf.
Subclass A is all tenants at Properties A who
- Entered into a new rental agreement or lease renewal between May 1, 2014 and January 16, 2020;
- Provided a security deposit which was held for more than six months; and
- Were not paid interest on the deposit each year, within thirty days after the end of each twelve-month rental period, at least once.
Subclass B is tenants at Properties B who
- Entered into a new rental agreement between June 1, 2015 and February 16, 2021;
- Provided a security deposit; and
- Were not given a disclosure in their lease of the name and address of the financial institution where their security deposit was being held.
Subclass C is tenants at Properties C who
- Entered into a new rental agreement or lease renewal between June 1, 2015 and February 16, 2020; and
- At least once were not given both RLTO summary documents at the beginning or at renewal of the lease.
You may be eligible for two settlement payments if you are a member of Subclass C and either Subclass A or B. You are not eligible for more than two payments. If more than one tenant lived in a unit during the same rental period, they are considered co-tenants and will be treated as a single tenant and will share equally in one share of the settlement unless they agree to a different distribution plan via a written, notarized request. Class members who were not tenants on the date of preliminary approval of this settlement, February 16, 2021, are former tenants. Those for whom the companies have no record of lawful tenancy are considered Unidentified Tenants and must submit a Claim Form and supporting documentation.Typical Settlement Amount:
Share of the net settlement fund, one per tenancy, based on the subclass to which the person belongs and the number of tenancies in the subclass, and the number of co-tenants sharing the tenancy. Estimated to be between $300 and $400 or more.
