Heartland Employment Services, LLC is putting up more than $5 million to settle an Illinois class action alleging it violated the Illinois Biometric Information Privacy Act (BIPA) when it took scans of workers’ fingers and shared them with its timekeeping vendor. BIPA imposes requirements on private companies that want to collect, store, or use biometrics. Among other things, it requires that companies must provide written notice and get written consent; have a plan for permanent destruction of data; and get consent for the sharing of biometrics.
