Case Summary:Genki Sushi is settling a class action alleging that the Hawaii Department of Health traced an outbreak of hepatitis A virus (HAV) to raw scallops served at its restaurants. The complaint claims that persons were exposed to the virus by eating at Genki Sushi, from contact with infected persons, or from other food establishments. Proof of Purchase:You must provide the date and place of exposure and proof that you received HAV blood tests, IG, or HAV vaccine. Acceptable proof of these includes a signed statement, documentation from a medical provider, or verification by your health insurer.
Eligibility:You may be eligible if
- You were exposed to the hepatitis A virus as a result of the outbreak infections linked to thirteen Genki Sushi restaurants on the islands of Oahu, Kauai, and Maui, but did not become infected, and
- As a result of the exposure, you obtained preventative treatment, such as immune globulin (IG), HAV vaccine, or an HAV blood test, within fourteen days of exposure.
Three subclasses have been defined. Subclass 1 includes persons with direct exposure, including family members and sexual partners of directly-exposed people. Subclass 2 is persons who were exposed by eating at one of the thirteen identified Genki Sushi locations between August 1 and August 16, 2016. Subclass 3 is those who were exposed by eating or drinking at one of the identified Secondary Establishments during specific dates.
