Case Summary:

On September 17, 2015, the South Carolina Department of Health and Environmental Control was notified of individuals employed by and working at Hardee’s Restaurants at the Lyman-area and Duncan-area locations in South Carolina who had tested positive for hepatitis A.  The plaintiffs in this lawsuit seek to recover compensation from Hardee’s Restaurants for all employees and customers who had to receive hepatitis A vaccinations as a result of exposure from Hardee’s in September 2015.

This settlement includes all those:

  • who consumed food or drink between September 4 and September 13, 2015, at the Hardee’s Restaurant located in Duncan, South Carolina, or between September 4 and September 15, 2015, at the Hardee’s Restaurant located in Lyman, South Carolina, and
  • subsequently obtained an HAV vaccination, an IG shot, or HAV blood test within thirty days after eating at these Hardee’s Restaurant locations, but in no event later than October 15, 2015.
Typical Settlement Amount:

Each claimant will receive a pro rata share of the total settlement amount based upon the number of valid claim forms submitted.
