Case Summary:The Hamilton Board of Education is making available $17 million to settle a lawsuit alleging that it breached its obligations to retirees, and in some cases to their dependents. The complaint alleges that collective bargaining agreements specified that retirees would be given a yearly cash payment in lieu of prescription drug coverage, but that the Board stopped making the payments between 2011 and 2013.

Eligibility:You may be eligible if you were formerly employed by the Hamilton Township Board of Education under a collective bargaining agreement (with the Hamilton Township Administrators and Supervisors Association, the Hamilton Township Education Association, or the Hamilton Township School Secretaries Association), and then retired, or if you were the dependent of such a retired employee. Five different subclasses have been approved, with different specifications and different retirement and benefit-ending dates. See the long-form Notice for details of each class.
Typical Settlement Amount:First, class members will be paid the amounts they would have received if the benefit had been paid through December 31, 2017. Second, payments will be made to all class members for the next ten years, in January of each year. Some payments will be made to deceased class members’ estates; dependents will age out at the age of 26 and payments will cease.
