Case Summary:

Marina Towers Associates, LP is on track to spend a total $42,000,000 to settle a class action about defects of apartments in the six buildings of its Gateway Plaza on South End Avenue in New York. The complaint alleged that residents could not properly heat or cool their apartments and had to use excessive amounts of electricity to try to do so. Other complaints included structural deterioration, fungal growth, and excessive condensation on windows. Marina Towers has already spent $18-20 million on improvements, which is considered to be part of the settlement, along with $13 million in rent increase limitations and $10,000,000 in cash.

Typical Settlement Amount:

Three benefits: (1) improvements already made to apartments, (2) a cap on rent increases for leases entered into between July 1, 2020 and June 30, 2022, and (3) cash distribution from the net settlement fund.
