Case Summary:

This is a different kind of settlement, involving a Fire Victim Trust to “evaluate, administer, process, and resolve eligible claims arising from the 2015 Butte Fire, 2017 North Bay Fires, and 2018 Camp Fire.” The Fire Victim Trust apparently has been assigned to handle claims against PG&E Corporation and/or Pacific Gas and Electric Corporation, alleging that they bear responsibility for the fires. The companies appear to be in Chapter 11 at this time.

The Trust will review claims to compensate fire victims for economic and noneconomic damage. The issues will include destruction or damage to real estate and personal property, additional living expenses, lost wages, business losses, personal injury and death, related medical expenses, and emotional distress.

Eligibility:

Eligibility is not as specifically defined as in most settlements. To be eligible for compensation from the trust, you must
- Have a claim related to one of the fires in question,
- File a Proof of Claim before the deadline, and
- Submit supporting documentation.
The Trust will review claims individually “and apply California law or, if applicable other non-bankruptcy law to determine the Approve Amount of the Claim, including all recoverable damages and costs…”
