Case Summary:

FedEx Supply Chain, Inc. is settling two cases at once. 

  • The background check case alleges that the company violated the Fair Credit Reporting Act and California laws because it did not provide the subjects of background checks with proper pre-screening disclosures. 
  • The wage and hour case alleges that the company violated the Fair Labor Standards Act and California labor laws by failing to give employees rest periods and failing to pay for all hours worked, among other things.

Eligibility:

You may be eligible for benefits from the background check case if you are a current, former, or prospective Genco I/FedEx employee in the US for whom the company obtained a background check between May 19, 2010 and August 13, 2018.

You may be eligible for benefits from the wage and hour case if you are a current or former non-exempt employee of Genco I/FedEx who worked for the company in the state of California at any time between June 24, 2012 and August 13, 2018. 

You do not need to do anything to obtain payment in either case, but if you fill out an opt-in form for the FLSA portion of the wage and hour case, and you worked for the company on or after June 24, 2013, you are likely receive more money.

Typical Settlement Amount:

Background Check Case: Pro rata share of 50% of the net settlement fund. Wage and Hour case: Share of the net settlement fund based on the dates and weeks you worked at the company and whether you fill out the FLSA opt-in claim form.
