Case Summary:

Facebook is paying $650 million to settle an Illinois class action alleging that its “Tag Suggestions” and other features involving facial scans violated the state’s Biometric Information Privacy Act (BIPA). Under the law, companies can’t collect, store, or use biometric information without first giving the subjects notice and obtaining their consent. The case alleges that Facebook used facial recognition technology to create facial templates which it collected and stored without consent.

You may be eligible if you are a Facebook user who lives in Illinois, has lived there for at least 183 days (six months), and for whom Facebook created and stored a face template after June 7, 2011.

Note that the class does not include all users of Facebook who live in Illinois. If your uploading of a photo or your tagging in another photo did not result in the creation of a face template, you are not a member of the class.

Typical Settlement Amount:

Estimated at $200-$400 per person; final amount depends on the number of valid claims received. Facebook is also required to turn off the Facial Recognition setting and delete face templates for most class members unless the class members turns the setting back on.
