Case Summary:

Experian is settling a class action alleging that it reported incorrect public records information on consumer credit reports. The complaint alleged that the information was wrong or belonged to other people, regarding such things as tax liens, civil judgments, and bankruptcies. The settlement provides for injunctive relief, that is, a change in Experian’s procedures, a mediation program to assess harm from the falsely-reported information, and two years of credit monitoring for each class member.

Eligibility:

You may be eligible if you belong to one of the two groups below.

  • You asked for and received a copy of your credit report from Experian between January 15, 2011 and September 21, 2018 and found it reported a tax lien, civil judgment, or bankruptcy, and the identity of the party that had provided that information to Experian was not provided.
  • Between January 15, 2011 and September 21, 2018, Experian provided your report to a third party, and the report contained a tax lien or civil judgment that was not yours or was not described accurately (for example, if a tax lien was described as unpaid when it had been paid, dismissed, or vacated). 
Typical Settlement Amount:

Two benefits: (1) Two years of credit monitoring; and/or (2) mediation and arbitration program to determine harm from the incorrect reporting. The program will be available for eighteen months.
