Case Summary:

Everi Holdings, Inc. and Everi Payments, Inc. are putting together $14 million to settle a class action brought against them under the Fair and Accurate Credit Transactions Act (FACTA). The complaint alleged that persons who engaged in quasi-cash or manual cash disbursements with Everli at a gaming establishment in the US or on tribal lands, using a debit or credit card, were given receipts that displayed four digits of a field on the receipt labeled “BIN.” FACTA regulates what credit card information may appear on printed receipts, among other things.

Eligibility:

You may be eligible if you are a person in the US who, between February 16, 2016 and December 31, 2019, (a) undertook a quasi-cash or manual cash disbursement transaction using a debit or credit card at a gaming establishment in the US or on tribal lands, (b) where the transaction was processed using Everi Payments’ CashClub technology, and (c) for which Everi’s system was programmed to generate a printed customer receipt that displayed four digits in a “BIN” field. The transactions were only in-person transactions done at cash cages in gaming establishments.

Typical Settlement Amount:

Pro-rata share of the net settlement fund, estimated at $40 to $60. Final amount depends on the number of valid claims submitted.
