The plaintiffs in this lawsuit allege that EOTech Holographic weapons sights are defective and result in four different issues including:
- “Reticle dimming” from moisture incursion,
- Movement of the reticle as the temperature changes known as “thermal drift,”
- Parallax, and
- Distortion of the reticle in cold weather

Unless he or she has already participated in the EOTech refund program, claimants must either return the EOTech sight or submit its serial number.Eligibility:
This settlement includes all United States residents who are the current owner of the following EOTech HWS Models that were manufactured between January 1, 2005, and November 1, 2016, and purchased on or before February 15, 2017 or who previously received a refund from EOTech for one of these HWS models:
- 512 CAMO,
- HHS I,
- HHS II,
- MPO II,
- MPO III,
- XPS2- Z,
- XPS2-300, and
Claimants can receive a refund for a new sight, or if they want to keep their sight they can receive $25-$50 in cash or a $100 voucher for a new sight.
