Case Summary:

This settlement concerns a number of asbestos-exposure cases between 1984 and 2009. In these cases, the complaint for this one alleges, Engelhard Corporation, its former law firm Cahill, and their employees made misstatements or hid evidence about the evidence for asbestos in Emtal industrial talc. Emtal talc was a brand of talc used to make industrial products, such as tires, paints, plaster, caulking, and auto-body repair compounds. (Note that this lawsuit does not involve talc in personal care products such as talcum powder.) Due to the misstatements and omissions, the complaint for this lawsuit contends, a large number of cases were either voluntarily dismissed by their plaintiffs or involuntarily dismissed by the courts.

Eligibility:

You may be eligible if you were a person in the US or its territories who, between March 8, 1984 and March 29, 2011, filed and served a lawsuit against the Engelhard/BASF companies claiming asbestos bodily injury, whose case was either voluntarily dismissed or terminated or involuntarily dismissed.

A “person” in this definition may be any individual or, if they are deceased, their estate, who claimed damages related to an asbestos bodily injury allegedly sustained from exposure to Emtal talc.

The Engelhard/BASF companies include BASF Catalysts LLC, BASF Corporation, BASF CE, BASF SE, Engelhard Corporation, Engelhard Industries, Engelhard Minerals & Chemicals Corporation, Minerals & Chemicals Philip Corporation, Eastern Magnesia Talc Co., Porocel Corporation, and Pita Realty Ltd.

Typical Settlement Amount:

The plan of distribution sets up three “parts” or compensation programs. Part A: Base Compensation Payments. Up to $500 or $1000 per claimant. Part B: For those with Asbestos Bodily Injuries. Up to an estimated $110,327. Part C: Extraordinary Injury Fund, for supplemental compensation to those with mesothelioma in exceptional cases. Final amounts from all parts depends on the number of approved claims.
