Case Summary:

Early Warning Services, LLC (EWS) is paying a little less than $4 million to settle a class action alleging the company violated the Fair Credit Reporting Act (FCRA) in two ways. First, the complaint alleged that when consumers asked for a copy of their files, EWS provided not the entire file but a “Summary File Disclosure” and the option to request a “Comprehensive File Disclosure.” The complaint also alleges that EWS did not use the word “fraud” in a consumer file when a “Fraud Record” was reported by a financial institution.

You may be eligible if you are a member of either of the following classes:

The (b)(2) Class is all natural persons living in the US who requested the contents of their files as maintained by EWS, between March 7, 2016 and February 21, 2020, and where EWS responded by providing a “Summary File Disclosure.”

The (b)(3) Class is all natural persons living in the US who requested the contents of their files as maintained by EWS, between March 7, 2016 and February 21, 2020, where EWS had in the file at least one fraud record, and where EWS provided a file disclosure that did not use the term “fraud.”

Typical Settlement Amount:

No payments for (b)(2) Class members. Estimated at $59 for (b)(3) Class members, but final amount will depend on the final amount of deductions from the settlement fund for attorneys’ fees and costs.
