Case Summary:This partial settlement, by Alcon Vision, LLC (formerly Alcon Laboratories, Inc.) and Johnson & Johnson Vision Care, Inc. (JJVCI), is the final one in a multidistrict antitrust litigation alleging that a group of manufacturers and a distributor adopted “Unilateral Pricing Policies” UPPs) for certain brands of disposable contacts in violation of antitrust laws. The complaint alleged that the companies used the UPPs to restrain competition on retail prices. Earlier settlements were reached in 2020 and 2021 with Bausch & Lomb, Inc., Cooper Vision, Inc., and ABB Optical Group, LLC.

Eligibility:You may be eligible if you are a person or entity living in the US who made retail purchases of disposable contact lenses made by Alcon, JJVCI, CVI, or B&L, between June 1, 2013 and December 4, 2018, for your own use and not for resale, where the prices of the products were subject to a Unilateral Pricing Policy and where the purchase occurred during a time when the UPP was in effect. A list of contact lenses and their UPP periods for eligible purchases can be found in the Notice at https://www.contactlenssettlement.com/Content/Documents/Alcon%20JJ%20Notice.pdf.
Purchases from 1-800-Contacts of disposable contact lenses subject to B&L’s UPP are excluded, if your purchase occurred on or after July 1, 2015.
Typical Settlement Amount:The proceeds of all the separate settlements in this case are being distributed together. Those who bought lenses made by B&L, JJVCI, and Alcon and subject to a UPP will receive funds on a pro-rata basis from all five settlement funds. Those who bought lenses subject to CVI’s UPP will receive funds on a pro-rata basis from the CVI, ABB, Alcon, and JJVCI funds.
It has been estimated that some 40 million consumers bought lenses that were subject to UPPs. The Notice says, “In the event that Lead Counsel determines that it will be economically infeasible to directly distribute the Net Settlement Funds to the Settlement Classes, they may propose alternative plans of distribution to the Court, including a cy pres distribution…”
