Case Summary:

Two defendants are settling an antitrust case about contact lens pricing, while three others are continuing the litigation. CooperVision, Inc. (CVI) and Bausch & Lomb, Inc. (B&L) have reached settlement agreements in a case claiming that five companies agreed to Unilateral Pricing Policies that set minimum prices and allegedly violated antitrust laws. The litigation is ongoing with the other three defendants—Alcon Vision, LLC, Johnson & Johnson Vision Care, Inc. (JJVC), and ABB Concise Optical Group, LLC.

Typical Settlement Amount:

Net settlement funds may be distributed to class members pro rata. However, since there may be as many as 40 million purchasers, it may not be feasible to distribute funds to each individual, and a different plan of distribution (such as charitable contributions) may be proposed. To minimize expenses, the CVI and B&L funds will be distributed at a later stage of the case.
