Case Summary:

RAM Partners, LLC and Tralee Affordable Panther, LLC, which does business as Deerfield Crossing Apartments, have chosen to settle a class action alleging that they unlawfully charged and threatened to charged certain fees to tenants when they filed summary eviction actions against them. The fees included complaint filing fees, sheriff service fees, and attorneys’ fees. The complaint alleged violation of the North Carolina Residential Rental Agreements Act, the North Carolina Debt Collection Act, among other things.

Eligibility:

You may be eligible if you belong to either of the classes below:

Collection Letter Class: Natural persons who, at any time between February 19, 2015 and June 25, 2018, lived in any of the properties in North Carolina owned or managed by the defendants in this case, and who received a letter saying either that they would be charged Eviction Fees or that they owed Eviction Fees. Eviction Fee Class: Persons who, at any time between February 19, 2015 and June 25, 2018, lived in any of the properties in North Carolina owned or managed by the defendants in this case, and who were charged and paid Eviction Fees.

If you are a member of the Eviction Fee Class, you are also a member of the Collection Letter Class. However, to receive Collection Letter Class benefits, you must file a claim.

Typical Settlement Amount:

Collection Class members: $50 for each collection letter sent to you by the defendants in this case, up to a maximum of $150. Eviction Fee Class members: Estimated at $340 for each time they were charged and paid eviction fees; final amounts will depend on the number of valid claims received.
