Case Summary:

This settlement resolves a class action against CSI Financial Services, LLC, which does business as ClearBalance. The complaint alleged that the company failed to take adequate measures to protect the personally identifiable information (PII) of loan recipients, leading to a data security incident that took place between March 8, 2021 and April 26, 2021. The PII may have included names, Social Security numbers, ClearBalance loan number and balance, banking information, clinical health information, or a full-face photograph.

Eligibility:

You may be eligible if you are a person to whom ClearBalance sent a Notice of Data Breach on or around July 9, 2021. You may also be a member of the California Subclass if you had a California address at the time of the data breach.

Typical Settlement Amount:

Benefits: (1) California cash payment: $100, for California Subclass members only. (2) Identity theft and credit monitoring: Two years of the Identity Theft Protection Package. (3) Reimbursement of out-of-pocket expenses: Up to $1,100 for expenses associated with dealing with the data breach, such as freezing or unfreezing credit reports and so on, incurred after March 8, 2021. (4) Reimbursement of extraordinary losses: Up to $5,000 for losses incurred on or after March 8, 2021, as a result of identity theft as a result of the data breach. Includes losses for such things as falsified tax returns, false claims for government benefits or medical treatment, and so on. (5) Reimbursement for time spent: Up to $67.50, or three hours at $22.50 per hour, for time spent regarding either out-of-pocket expenses or extraordinary losses. Losses must be fairly traceable to the data breach.

All claims submitted in this settlement are subject to a maximum total amount of $2,650,000. If total claims exceed this amount, payments may be reduced pro rata.
