The Claim Form says, “You may obtain a list of potentially eligible invoice(s) … and amount paid from the Claims Administrator to assist in completing this Proof of Claim Form. For each potentially eligible invoice, you must submit a separate Proof of Claim Form.” You should also submit a copy of your request letter.

Eligibility:

You may be eligible if you are a person who made a qualifying request for medical records between September 13, 2015 and July 26, 2022, and if you are in either of the subclasses below:

- Settlement Subclass A is all persons who, on one or more occasions during the above class period, (1) asked for copies of medical records from a Texas clinic or Texas hospital, or had copies requested by some other person pursuant to their authorization, (2) specifically requested in your request letter that the copies be delivered in an electronic format, (3) were charged more than the applicable Electronic Rate, (4) paid Ciox more than the applicable Electronic Rate, and (5) were not reimbursed for the Disputed Fee amount by Ciox.

- Settlement Subclass B is all persons who, on one or more occasions during the above class period, (1) asked for copies of medical records from a Texas clinic or Texas hospital, or had copies requested by some other person pursuant to their authorization, (2) did not request in your request letter that the copies be delivered in an electronic format, but received electronic copies via the Ciox eDelivery Portal pursuant ot their registration for the same, (3) were charged more than the applicable Electronic Rate, (4) paid Ciox more than the applicable Electronic Rate, and (5) were not reimbursed for the Disputed Fee amount by Ciox.

Note that if you were reimbursed by a client for the Disputed Fee amount, the client is the Settlement Class member. If you were not reimbursed by client for the Disputed Fee amount, you are the Settlement Class member. If you have multiple qualifying requests that qualify for a complete or partial reimbursement, you may be a Settlement Class member for some and your client may be the Settlement Class member for others.

Typical Settlement Amount:

Settlement Subclass A: Reimbursement of 100% of the total amount of the Disputed Fee amount less the percentage of the settlement fund awarded to class counsel for their work on this case. Settlement Subclass B: Reimbursement of 50% of the total amount of the Disputed Fee less the percentage of the settlement fund awarded to class counsel for their work on this case.

If the reimbursement total would exceed the total of the settlement fund, reimbursements will be made on a pro-rata basis.
