Case Summary:CertainTeed has reached a settlement in a class action that alleges that its fiber cement siding is defective and has failed to perform as promised. The siding in question is CertainTeed WeatherboardsTM Fiber Cement Siding, Lap Siding, Vertical Siding, Shapes, Soffit, Porch Ceiling, and 7/16” Trim. The plaintiff claims that when CertainTeed sold its siding, it promised that the siding would be “free from manufacturing defects for a 50-year period.” The plaintiff alleges that despite this claim, the siding fails prematurely, causing crazing, warping, bowing, discoloration, shrinkage, and excessive gapping, causing damage to underlying structures.

Eligibility:You may be eligible if, as of September 30, 2013, you owned a home or other building in the US on which the siding was installed on or before September 30, 2013, and on which the siding is showing qualifying damage.
If you’ve sold this building, you may file a claim:
- (a) if the purchaser assigned you that right in writing, and
- (b) if you make the claim within 90 days of the settlement of the sale.
If you purchased a building on which the siding was installed on or before September 30, 2013, the seller did not retain the right to make a claim, you may file a claim.
If you previously settled a warranty claim for damage to the siding, you cannot make a claim for the same damage; you can only make a claim for new damage to the siding.
