Case Summary:

When consumer debts are discharged in a Chapter 7 bankruptcy, companies that furnish credit information to credit reporting companies must update the information they provide to show that the debts were discharged. This settlement resolves a class action alleging that Capital One did not do this when the debts were discharged in bankruptcy after they were sold. The complaint alleged that the information continued to show debt information and did not show that the debts were discharged in bankruptcy. The complaint claims that some people made payments in order to keep the false entries from impacting their credit ratings.

Eligibility:

You may be eligible if you are an individual 

  • Who had a Capital One credit card account
  • Whose debt on that account was charged off and then sold to a debt buyer, on or after January 1, 2008, and
  • Who, after that sale, received a discharge of the debt as a result of a Chapter 7 bankruptcy, through March 22, 2016.
Typical Settlement Amount:

Reimbursement: If you made a payment to the debt buyer after bankruptcy and the payment was not returned, you may receive up to 100% of the amount you paid. Distribution: If you did not make a payment, you may receive a pro-rata share of the remaining net settlement fund after other payments have been made. Final amounts depend on the number and dollar amount of other claims received.
