Case Summary:

The plaintiffs in this case allege that certain companies conspired to fix, raise, maintain, or stabilize the prices of capacitors, and that customers therefore had to pay more for capacitors than they would have otherwise.

So far, settlements have been reached with three defendants: NEC Tokin Corp. and NEC Tokin America, Inc. (“NEC Tokin”); Okaya Electric Industries Co., Ltd. (“OEI”); and Nitsuko Electronics Corporation (“Nitsuko”).  The case continues against multiple remaining defendants.

  • The NEC Tokin class includes US persons and entities that, between April 1, 2002 and July 15, 2016, purchased from a distributor capacitors manufactured by a defendant or alleged co-conspirator manufactured.
  • The Okaya class includes US persons and entities, between January 1, 2002 and April 14, 2016, purchased from a distributor capacitors manufactured by a defendant or alleged co-conspirator.
  • The Nitsuko class includes US persons and entities that, between January 1, 2003 and March 29, 2016, purchased from a distributor capacitors manufactured by a defendant or alleged co-conspirator.
