Case Summary:

In partial settlement of a class action, the Burley Tobacco Growers Cooperative Association will be dissolved, its assets sold, and the proceeds applied to its debts, with the remainder distributed to the members. The complaint alleged that the co-op had breached its duties to its members and no longer fulfilled a purpose. A Dissolution Committee, supervised by the court, will oversee the sale of its assets and the distribution of the proceeds. This is a partial settlement because it does not resolve all of the claims made in the lawsuit.
