Bangor Savings Bank Overdraft/NSF Fee Settlement

Settlement Structure: Claims Made

Active: Open

Case Summary:

Bangor Savings Bank is putting up $2 million to settle a class action alleging it charged customers improper overdraft or non-sufficient funds fees. The complaint claimed the bank charged these fees in two situations: (1) for automated clearinghouse transactions that were resubmitted by a merchant after the bank had declined to pay them the first time (retry claims), and (2) for debit card transactions that were authorized into an account with a positive balance but settled when the account had a negative balance (APPSN claims). The complaint alleged that both kinds of charges violated the bank’s account agreements with customers.
