CPG International, the company behind AZEK Building Products, has agreed to a settlement to resolve a class action alleging that it claimed certain historical AZEK decking would not fade, stain, scratch, or discolor. The complaint alleges that the decking did in fact fade, stain, scratch, and discolor and that CPG should have warned its customers.

Eligibility:

You may be eligible if

  • You bought AZEK decking for your home between August 1, 2007 and December 31, 2012,
  • The color of the decking was brownstone, clay, slate gray, ivory, white, fawn, Kona, Sedona, Tahoe, acacia, morado, or redland rose, and
  • You still own the home at which the AZEK decking was installed.

(Some of the above colors continued to be sold after 2012, but the settlement only includes decking sold up until the end of that year.)

Typical Settlement Amount:

10% of cost of decking, not including labor or deck parts, up to $2,000; offset by (a) any prior cash refund for the same allegations, (b) any previously-provided decking replacement in the amount of $2 per linear foot, (c) any professional cleaning or conditioning previously provided in the amount of $1 per linear foot, and (4) the price of any DeckMax previously provided, at $50 per bottle.
