Case Summary:

This settlement resolves a class action against Avis Budget Group, Inc. and Highway Toll Administration, LLC about the disclosure of charges for e-tolls, or electronic tolls, to customers. The complaint alleged the companies, in collecting these charges, breached the Avis and Budget rental agreements, the implied covenant of good faith and fair dealing, and/or the New Jersey Consumer Fraud Act and caused the companies to be unjustly enriched.

Proof of Purchase:

The records of the defendants in this case will be used to calculate the amount you receive in this case. If you do not want to rely on their records, you can submit your own records along with your claim to show proof of your e-Toll payments on Avis or Budget rentals during the class period. If the defendants have no records for you, you must also show your own records.

You may be eligible if you are a US resident, and (1) you rented an Avis or Budget vehicle from a company-owned location in the US during the class period, and (2) in connection with that rental, you paid Avis, Budget, or Highway Toll Administration for the use of e-Toll. The class period for most states is April 1, 2007 to December 31, 2015, except for rental transactions originating in Florida, Texas, and Colorado, for which the class period is March 2, 2009 to December 31, 2015.

Typical Settlement Amount:

You will receive a partial reimbursement of your eligible e-Toll-related charges, calculated according to a formula. Payments will not be made or will be reduced by any amount previously refunded to you by the defendants, and also if the charges were paid directly by a third party through a central billing account. Also, if the combined amounts of all valid claims and other payments in connection with the lawsuit would cost more than $45 million, claim payments will be reduced on a pro-rata basis.
