Case Summary:

This is a $67 million partial settlement by defendants JPMorgan Chase & Co., Wells Fargo & Co., Wells Fargo Bank, Bank of America, NA, and Bank of America Corporation. These companies have agreed to settlements in a larger class action alleging that a number of banks and other entities violated federal antitrust laws by imposing restraints that raised ATM surcharges. The complaint alleged that when consumers used bank cards for a cash withdrawal at an ATM owned by an entity other than their card issuer, they were assessed an inflated surcharge.

The case is ongoing against the defendants who have not settled, including Visa, Inc., Visa USA, Inc., Visa International Service Association Plus System, Inc., Mastercard, Inc., Mastercard International, Inc. (which does business as Mastercard Worldwide), and NB Holdings Corporation.

Eligibility:

You may be eligible if you are an individual or entity who paid an unreimbursed ATM access fee directly to any of the bank defendants or bank co-conspirators, at an ATM owned by an entity different from the one that issued your card, to withdraw cash at an ATM located in the US, at any time between October 1, 2007 to November 12, 2021.

You are not eligible if all of your surcharged ATM transactions were reimbursed, or if the card you used was issued by a financial institution located outside the US.

Typical Settlement Amount:

Pro-rata share of the net settlement fund. Payment amount depends on the number of valid claims received.
