Case Summary:

American Income Life Insurance Company is choosing to settle a class action alleging the company violated the California Labor Code and the state’s Industrial Welfare Commission Wages Orders, among other things, by failing to pay for all hours worked, including for time spent training. The complaint also claimed the company did not provide overtime pay for overtime hours worked, meal and rest breaks, waiting time penalties, and accurate wage statements, and did not reimburse work-related expenses. There was an earlier version of this settlement, but the judge did not approve the allocation of payments it set forth.

You may be eligible if you trained and/or worked as a sales agent for AIL in California on or after September 12, 2014, and if your work began before August 16, 2019. You may receive two different amounts, from two different settlement funds.

All class members may receive payment from the All Trainees and Agents Fund, based on the number of weeks worked during the relevant time period. If you received the Notice for the settlement, you are a member of this class.

Certain class members will also receive a payment from the Terminated Trainees and Agents Fund if your association with AIL ended between September 12, 2015 and August 16, 2019.

Typical Settlement Amount:

Payment amounts vary, according to the number of weeks each class member trained or worked. A formula for allocation is set forth in the Notice, where training weeks will have twice the weight of work weeks.
