Case Summary:

Amazon.com Services, LLC and Amazon.com, Inc. are settling a class action about wages and hours. The complaint alleged Amazon (1) rounded workers’ starting and stopping times in a way that disadvantaged employees, (2) did not pay for clocked-out rest periods that were shorted than thirty minutes, and (3) did not promptly pay all wages due at termination, in violation of Oregon labor laws.

You will receive your share of the Guaranteed Funds whether you submit a Claim Form or not, but you must submit a Claim Form to receive your share of the Claimable Funds.

Eligibility:

You may be eligible if you are in either of the classes (with two subclasses) below:

- The Rounding Class is current and former Amazon employees who worked in the DPD1, PDX5, PDX9, or UOR1 facilities in Oregon in any workweek with a regular payday on or after December 20, 2012 and on or before April 15, 2019, during which they lost time due to Amazon’s rounding policy.
- The Rounding Penalty Subclass is members of the Rounding Class whose employment terminated on or after December 20, 2015 and on or before April 15, 2019.

- The Unpaid Break Class is current and former Amazon employees who worked at any Oregon facility in any workweek with a regular payday on or after December 20, 2012 and on or before April 15, 2019, during which they had a clocked-out break of fewer than thirty minutes.
- The Unpaid Break Penalty Subclass is members of the Unpaid Break Class with a clocked-out break of fewer than thirty minutes in any workweek with a regular payday on or after December 20, 2015 and on or before April 15, 2019

Typical Settlement Amount:

The settlement money will be divided into two funds, the Guaranteed Funds and the Claimable Funds. The Guaranteed Funds will be distributed to all class members on a pro-rata basis. The Claimable Funds will be distributed based on membership in one or both penalty subclasses.
