Case Summary:This settlement resolves a pollution class action against 3M Company, Daikin America, Inc., Dyneon, LLC, Synagro WWT, Inc., Synagro South, LLC, Toray Fluorofibers (America), Inc., BFI Waste Systems of Alabama, LLC, BFI Waste Systems of North America, LLC, the City of Decatur, Alabama, and Morgan County, Alabama. The complaint alleges that the companies released certain per- and polyfluoroalkyl substances, polluting the Tennessee River and surrounding soil, groundwater, air, and fish.

Eligibility:You may be eligible if you are a person who has owned, occupied, had an ownership or possessory interest in, lived at, maintained a business at, worked at, or recreated on any real property, including the Tennessee River, its tributaries, and other bodies of water, located in Morgan, Lawrence, Franklin, Limestone, Colbert, or Lauderdale Counties, in Alabama, at any time between April 21, 2003 and December 17, 2021.
A Sludge Application Settlement Subclass has also been defined, to include all class members who, as of December 17, 2021, own, occupy or have a possessory interest in real property in Morgan, Lawrence, Franklin, or Limestone Counties, Alabama, on which biosolids containing PFAS compounds were applied at any time.
Typical Settlement Amount:(1) Equitable relief requiring the Synagro defendants to provide investigation, remediation, and monitoring of sites, soils, basins, ponds, groundwater, and fish. (2) Monetary compensation for Sludge Application Settlement Subclass Members (but not for other class members) from some of the defendants. Portion of $5,000,000 minus administration costs.
Total Settlement Amount: Approximately $300,000,000 for PFAS-related investigations, monitoring programs, and remediation projects
