Case Summary:This settlement resolves a class action alleging 3M Company, Dyneon, LLC, and Daikin America, Inc. contaminated drinking water sources, including for customers of West Morgan-East Lawrence Water and Sewer Authority (the Authority), Town Creek Water System, West Lawrence Water Cooperative, VAW Water System, and Trinity Water Works. The complaint alleged that the companies discharged per- and polyfluoroalkyl substances (PFAS), including Perfulorooctanoic acid (PFOA) and Perfoluorooctanesulfonate (PFOS) into the Tennessee River.

Eligibility:You may be eligible if you belong to either of the following subclasses:
Ratepayer Subclass: All those who were
- Residential customers of the Authority, Town Creek Water System, the West Lawrence Water Cooperative (Route 20 residential customers only), the VAW Water System (Routes 08 through 19 residential customers only), or the Trinity Water Works, at any time between October 5, 2013 and September 29, 2016, and
- Made any payment for water originating with the Authority, whether the water was provided directly by the Authority of through one of its wholesale customers, that is, the Town Creek Water System, the West Lawrence Water Cooperative (Route 20 residential customers only), the VAW Water System (Routes 08 through 19 residential customers only), or the Trinity Water Works, between the following dates: November 1, 2013 and October 31, 2016 in the cases of residential customers of the Authority, Town Creek, and West Lawrence; or November 1, 2013 and June 30, 2016 in the cases of residential customers of the VAW Water System and the Trinity Water Work.
Resident Subclass: All those who currently live in Alabama, Georgia, or Tennessee and for at least six months
- Between October 5, 2013 and September 29, 2016, in the case of residential customers of the Authority, Town Creek Water System, and the West Lawrence Water Cooperative (Route 20 only) or
- Between October 5, 2013 and May 31, 2016, in the case of residential customers of the VAW Water System (Routes 08 through 19 only) and the Trinity Water Works,
owned or lived in a residence that received water originating with the Authority, whether the water was provided by the Authority or through one of its wholesale customers, that is, Town Creek Water System, West Lawrence Water Cooperative (Route 20 residential customers only), the VAW Water System (Routes 08 through 19 residential customers only), or the Trinity Water Works.
Ratepayer Subclass: For most, pro rata share of $6,375,000, up to $745. For small accounts that were short-lived or did not have many charges, minimum payment of $50. Resident Subclass: Payment of $50-$100 as a share of $1,000,000.
