Case Summary:

Ascenda USA, Inc., doing business as 24-7 InTouch, has agreed to form a settlement fund of over a million dollars to settle a class action alleging that its handling of background checks for prospective employees violated the Fair Credit Reporting Act (FCRA). The complaint claims that Ascenda’s Disclosure and Authority to Release Information form contained extraneous information and that, for some persons, the company did not provide a timely copy of the background report and a summary of rights prior to taking adverse action based upon the report.

Typical Settlement Amount:

Pro-rata share of the net settlement fund, estimated to be roughly $60 for members of the Disclosure Form Class, or possibly more for members of the Pre-Adverse Subclass.
