Seresto Flea & Tick Collars and Pet Injuries California Class Action

When Amanda Merriman put Seresto Flea & Tick Collars on her two dogs, the complaint for this class action alleges, they experienced hair loss, welts, itching, and vomiting. Although she had them professionally washed and bought them special food and special shampoo, their problems continued, until she removed the collars. The complaint alleges that Bayer Healthcare, LLC and Elanco Animal Health, Inc. have been asked to recall the collars but have refused to do so.

The California Class for this action is all persons in California who bought the products from the beginning of the applicable statutory period to the present.

According to the complaint, the Environmental Protection Agency (EPA) has received reports of more than 75,000 incidents related to the Seresto collars. The incidents include nearly 1,700 pet deaths and nearly 1,000 instances of harm to humans. The complaint also cites an investigative article that reports on the risks posed by the collars, going all the way back to the collar’s release in 2012.

When Amanda Merriman put the collars on her two dogs, Molly and Micah, the complaint says, she soon noticed that the dogs “were suffering harm—experiencing significant hair loss, developing welts, itching, and vomiting.” She hired a professional dog groomer to bathe the dogs, to help with the skin irritation, then bought them special food and a special shampoo. But none of these efforts improved their condition until she took off the collars. After she did that, the dogs healed.

The complaint alleges, “The harm caused by Seresto Collars is due to the dangerous chemical cocktail of pesticides that are used in the Products.” This “chemical cocktail” includes two pesticides: imidacloprid, which is usually used on crops, and flumethrin, which the complaint claims “is only actively included as an ingredient in one product—Seresto Collars—according to EPA documents.”

According to the complaint, pets who wear the collars “can suffer injuries, including rashes, increased lethargy, vomiting, loss of appetite, seizures, or even death.”

The complaint also reports injuries to humans, including, for example, a “12-year-old boy who slept in a bed with a dog wearing a collar [who] started having seizures and vomiting” and a “67-year-old woman who slept in a bed with a dog wearing a collar [who] reported having heart arrhythmia and fatigue.”

Flea and tick collars are meant to keep pets safe from insects and the diseases they can cause. But instead, the complaint alleges, “the Seresto Collars are anything but safe for Pets, as they can and have caused Pets (and their owners) to suffer serious injuries.”

The causes of action include breaches of warranties and false advertising, among other things.
