
Elanco Animal Health, Inc. and Bayer Corporation make Seresto flea collars for pets. This class action brings suit against the companies for their “willful, reckless, and negligent marketing and sale” of the collars because, the complaint says, they “cause serious health consequences to dogs, cats, and human.” The complaint alleges the collars have been linked to 75,000 incident reports, 1,698 pet deaths, and 1,000 reports of harm to humans.
The class for this action is all persons in Pennsylvania who bought a Seresto flea and tick collar, between March 31, 2015 and the date of the certification of the class in this case.
The Seresto flea collars were originally designed by Bayer and are now sold by Elanco. They are intended to release a small amount of insecticide over time to protect animals from fleas, ticks, and other pests. The collars use two different pesticides, imidacloprid and flumethrin.
Plaintiff Kevin Levensten bought a Seresto collar for his dog. Unfortunately, after he put the collar on the dog, it began experiencing seizures.
Reported effects of the Seresto collars on pets include seizures, rashes, and death. Effects on humans, the complaint alleges, include “rashes, neurological issues, heart palpitations, nausea, eye irritation, ocular pain, ocular redness, blurred vision, eyelid edema, numbing, skin lesions, rhinitis, urticaria, pruritus, erythema, conjunctivitis, nasal irritation, and nasal discharge.”
According to the complaint, the Environmental Protection Agency (EPA) “links the incidents to flumethrin…. The Products are the only flea collar registered with the EPA that uses flumethrin.”
Despite the now long list of incidents reported relating to the collars, the labels and packaging do not warn consumers about the risk of adverse health effects.
“In fact,” the complaint alleges, “the package inserts warn only that ‘scratching, redness, and hair loss’ may occur ‘rarely’ and that it is not necessary to remove the collar to treat these conditions. The package inserts further warn that ‘dermatitis, inflammation, eczema or lesions’ occur only ‘in very rare cases.’” The product does not contain any warnings of adverse effects on human beings.
The complaint alleges that the companies knew or should have known about the possible severe effects on cats and dogs as well as on humans.
The complaint claims that the statutes of limitations that might have applied to the products be tolled because of the companies’ “fraudulent misrepresentation, suppression and concealment of material facts…”
The thirteen counts include violations of the Pennsylvania Unfair Trade Practices and Consumer Protection Law, breach of express and implied warranties, negligence, and fraud, among other things.
