Secretlab False Discounts on Gaming Chairs California Class Action

Secretlab US, Inc. sells gaming chairs and often advertises discounts on these chairs. But the complaint for this class action alleges that the discounts are false, because they are based on fictitious “original” prices, or false reference prices, at which the chairs are seldom or never offered.

A class and a subclass have been defined for this action.

  • The California Class is all residents of California who bought the products within the applicable statute of limitation.
  • The California Consumer Subclass is all residents of California who bought the products for personal, family, or household purposes, within the applicable statute of limitations.

The products at issue include the following:

  • Secretlab Titan 2020 chairs
  • Secretlab Omega 2020 chairs
  • Secretlab Throne 2020 chairs
  • Secretlab Titan XL 2020 chairs
  • Secretlab Omega 2018 chairs
  • Secretlab Titan 2018 chairs
  • Secretlab Throne 2018 chairs

According to the complaint, the chairs were either offered for sale at the “original” prices or they “were offered for the original price for an inconsequential period of time and then continuously discounted, rendering the purported original price … false and misleading.”

The complaint quotes the Code of Federal Regulations as saying that if a “former price being advertised is not bona fide but fictitious—for example, where an … inflated price was established for the purpose of enabling the subsequent offer of a large reduction—the ‘bargain’ being advertised is a false one; the purchaser is not receiving the unusual value he expects.”

California law, also quoted in the complaint, is even more specific: “No price shall be advertised as a former price … unless the alleged former price was the prevailing market price … within three months next immediately preceding the publication of the advertisement or unless the date when the alleged former price did prevail is clearly, exactly and conspicuously stated in the advertisement.”

The chairs are only sold on Secretlab’s website, the complaint claims. It lists advertised original prices for several chairs along with their advertised sale prices for a number of months. For example, for the Secretlab Titan 2018 chair, it shows a consistent advertised price of $500, while five advertised sale prices for various months between February 2018 and January 2020 are listed as $369, $389, $389, $349, and $379.

The complaint alleges that Secretlab falsely advertised the products to induce consumers to buy them. “By the use of the Sale Representations,” the complaint alleges, Secretlab “created increased market demand for the Products and increased its market share relative to what its demand and share would have been had it marketed the Products truthfully.”
