River City Casino & Hotel Severance Agreement Class Action

This class action brings suit against PNK, LLC, which does business as River City Casino & Hotel. According to the complaint, River City laid employees off in April without pay, promised in August in a written severance agreement to pay them until the 17th of that month, but then allegedly never paid them anything.

The class for this action is all US citizens and residents who (1) were an employee of the River City Casino & Hotel; (2) were laid off in April 2020; (3) were not paid by River City from that time until August 17, 2020; (4) were given a severance contract by River City; and (5) signed and returned the contract.

Plaintiff Louis Grone worked for River City. He is a resident of St. Louis County, Missouri, as is River City. Although the complaint does not provide much detail, it seems that he and at least some of his fellow workers were furloughed without pay on or about April 1, 2020.

The complaint alleges, “Plaintiff Mr. Grone, and all others similarly situated, and [River City] entered into a Severance Agreement on or about August 17, 2020.” The agreement specified, the complaint claims, that River City would pay Grone and the others involved their “regular salary and benefits through August 1, 2020.” The Severance Agreement is attached to the complaint as Exhibit 1.

The complaint does admit that River City “has provided health insurance and life insurance for [Grone] and all others similarly situated, since the start of the furlough as required by the severance agreement.

According to the agreement, however, River City was also supposed to provide Grone and the others with their full salaries, from April 1 until August 17. However, the complaint alleges that River City “has not paid Mr. Grone, and all others similarly situated any amount of their salaries since April 1, 2020.”

Oddly, Grone’s signature on the attached agreement is August 24, 2020—a week after the agreement’s end date. No explanation is given for this.

The sole count is breach of contract.
