Richard Sokoloff Deceptive Representation Debt Collection Class Action

This class action alleges that Richard Sokoloff and others violated the Fair Debt Collection Practices Act in trying to collect a debt.

The complaint alleges that the plaintiff owed money to Princeton Radiology Associates and that the debt was later transferred to Mr. Sokoloff, who sent plaintiff a letter attempting to collect the debt on December 25, 2014. According to the complaint, under “very truly yours,” the letter showed the names of Richard Sokoloff, Esq. and Jeffrey Pilinko, Esq. However, neither of these persons, nor any person at the Richard Sokoloff firm, were licensed to practice law in New Jersey at the time. Thus, the complaint says, the letter gave the impression of legal action or the involvement of attorneys in the collection of the debt.

The complaint alleges that Richard Sokoloff sends letters and notices to debtors which violate the law on fair debt collection practices by:

  • Using false, deceptive or misleading representations to try to collect a debt;
  • Threatening to take action that cannot legally be taken or that is not intended to be taken;
  • Using unfair or unconscionable means to try to collect a debt; and
  • Making a false representation or implication that an attorney is meaningfully involved.

The class for this action consists of all New Jersey consumers who were sent letters or notices from Richard Sokoloff which contained at least one of the alleged violations in 15 USC §1692. The class period is the year prior to the filing of this case.
