Real Time Resolutions Settled-Debt Collection Class Action

This class action alleges that Real Time Resolutions attempted to illegally collect a debt in violation of federal and state debt collection laws.

The complaint alleges that the plaintiff incurred a debt for personal expenses that was later assigned to National Attorney Collection Services (NACS). According to the complaint, NACS then attempted to collect the debt in ways that violated federal laws and the plaintiff sued. The case was settled in a way that resolved the debt.

Sometime after that, the debt was transferred to Real Time Resolutions. Although the debt had been settled, the complaint alleges, Real Time Resolutions began to try to collect it, thus violating state and federal laws on false representation of a debt and other unfair practices.

Also, the complaint claims, Real Time attempted to collect an additional $15 in fees along with the debt, which it was not authorized to collect, and did not name the original creditor to whom the debt was owed, thereby not allowing the plaintiff to understand which debt Real Time was attempting to collect.

This class action has been filed for the benefit of five classes, including all persons in the US or the state of California who received one or more consumer debt collection letters from Real Time, at any time one year prior to the filing date of this action.

  • that identified REC Acquisitions LLC (Real Time) as the original creditor;
  • that charged them for “other fees”; or
  • for those in California, that did not include the Rosenthal Notice, as required under California debt collection law.
