Rand McNally Defective TND Tablet 80 Truck GPS Class Action

Rand McNally makes a GPS system called the TND Tablet 80 Truck GPS. The complaint for this class action alleges that the system has a “propensity for failure and malfunction.” It brings suit under fraud, fraudulent concealment, and breach of warranty statutes.

Two classes have been defined for this action.

  • The Nationwide Class is all current and former purchasers of the Rand McNally TND Tablet 80.
  • The Multi-State Consumer Protection Class is all current and former purchasers of the Rand McNally TND Tablet 80 in Illinois or any state with similar laws.

Rand McNally touted its system as superior, with “advanced lane guidance” and help in navigating complex intersections, with “all the capabilities and features of Rand McNally’s industry-leading IntelliRoute® TND™truck GPS devices.” Plaintiff James Van Zeeland believed the company was a reputable brand that offered reliable, good-quality products. In May 2019, he bought the TND Tablet 80 for use in his truck for $449.99.

However, the system has egregious flaws, the complaint alleges: “The system directs drivers to unsafe terrain or hazardous road conditions, distracts or confuses drivers, or otherwise suddenly fails to properly work or function at all, thereby placing drivers at greater risk of accidents and harm.” Rand McNally did not warn customers of these flaws.

Weirdly, it often showed Van Zeeland’s truck to be on a parallel or nonexistent road, the complaint claims, revising its directions accordingly. It has also “direct[ed] him to the wrong locations, and tak[en] him in the opposite direction.” Also, “[w]hile driving through cities, the vehicle icon TND Tablet 80 would continuously spin and jump between overpasses and underpasses.”

The complaint alleges that his “problems with his TND Tablet 80 were neither limited nor occasional—he experienced these problems most of the time he used the TND Tablet 80>’

The complaint quotes similar online postings from other users:

  • “Started malfunctioning after three months…. Maps freezing all the time…”
  • “…Doesn’t know left from right…”
  • “…keeps rerouting because it picks up Street Parallel to where you actually are…”
  • “…losing the GPS signal, inaccurate routing, and misreporting of vehicle speed…”

The complaint alleges that Rand McNally must have known about the problems from so many postings and telephone calls. In fact, some of the postings report that Rand McNally said it was working on a fix for them. However, the complaint alleges that to date no fix exists.

Van Zeeland was unable to get help from the company, despite numerous calls.

The complaint alleges that the defective navigation system puts truck drivers in a potentially dangerous situation.
