Pyrex Products Not Always “Made in the USA” Class Action

The complaint for this class action calls Pyrex items “quintessential Americana” in part because of their “history of being made entirely in the United States.” It brings suit against Instant Brands, LLC, presumably the owner of the Pyrex brand, alleging that the company markets Pyrex items as being made in the USA, when recently many Pyrex items have been made in China.

Two classes have been defined for this action:

  • The Maryland Class is all persons in Maryland who bought Pyrex products during the applicable statutes of limitations.
  • The Consumer Fraud Multi-State Class is all persons in Georgia, West Virginia, Texas, Montana, Idaho, New Mexico, Alabama, Utah, North Dakota, South Dakota, Nebraska, Iowa, Kansas, Mississippi, Arkansas, Alaska, Wyoming, and South Carolina who bought Pyrex products during the applicable statutes of limitations.

Pyrex was invented in Corning, New York more than a hundred years ago, as the complaint alleges: “A small company known as Corning Glass Works developed a borosilicate glass called ‘Nonex’ based on the battery jars and railroad lanterns of the era, which could withstand extreme temperatures without breaking.”

The complaint quotes unnamed sources to say, “Pyrex items are ‘regularly handed down from one generation of home cooks to the next,’ and ‘[are] sentimentally linked to sweet memories of baking with Grandma.’”

Page 3 of the complaint reproduces a Pyrex ad, which says, in part, “Born of innovation, the iconic Pyrex brand evokes some of our fondest family food memories, and has had a place in our hearts and homes for over 100 years.” The complaint also quotes the company as saying, “Pyrex value[s] our made in USA heritage” and its YouTube page also promotes Pyrex products as still being made in the USA.

“However,” the complaint alleges, “owing to an increase in demand for kitchenware during the Coronavirus pandemic, domestic supply of Pyrex was insufficient in part due to stay-at-home orders issued in many states.” Because of this, the complaint alleges, certain Pyrex products started to be made in China. How do we know this? The complaint alleges that the items made in China had a small print statement revealing where they were made.

But Pyrex did not tell its customers this, the complaint alleges, but went on marketing certain Chinese-made measuring cup sets as being “Made in the USA.”

According to the complaint, the Federal Trade Commission (FTC) sets the standards for “Made in the USA” claims. The complaint contends that the Pyrex products that were manufactured in China do not qualify for that designation, because the materials all came from elsewhere and the items were manufactured entirely in China.
