Purely Elizabeth Foods High Protein Claims Class Action

Purely Elizabeth, LLC offers oats, oatmeal, granola, and mixes for breads, muffins, pancakes, and waffles. It purports to offer high amounts of protein in certain products, but the complaint for this class action alleges that the products do not offer as much protein as they claim to, and that the protein is of an inferior type.

The class for this action is all natural persons in California who bought any of the products below between March 31, 2017 and the present:

  • Maple + Almond Butter Nut Butter Ancient Grain Granola – 6g
  • Chocolate Peanut Butter Ancient Grain Granola – 6g
  • Maple Walnut Probiotic Granola – 4g
  • Vanilla Almond Butter Grain-Free Granola + MCT Oil – 5g
  • Chocolate Hazelnut Grain-Free Granola + MCT OIL – 5g
  • Coconut Cashew Grain-Free Granola – 4g
  • Banana Nut Butter Grain-Free Granola – 3g
  • Cinnamon Peanut Butter Grain-Free Granola + MCT Oil – 5g
  • Grain Free Protein + Collagen Pancake Mix – 11g
  • Grain-Free Pancake & Waffle Mix – 6g
  • Ancient Grain Pancake & Waffle Mix – 7g
  • Grain Free Bread and Muffin Mix – 7g
  • Grain-Free Protein + Collagen Bread & Muffin Mix – 9g
  • Original Superfood Oat Cups with Granola Topper – 9g

The complaint says that Purely Elizabeth labels its packages to claim its products provide specific amounts of protein per serving, such as “7 protein” on its Vanilla Pecan Collagen Protein Oats.

However, the complaint alleges that the products don’t deliver the amount of claimed. For example, it says, the Vanilla Pecan Collagen Protein Oats product actually provides only 6 grams of protein.

Also, the complaint claims that the company “uses proteins of low biological value to humans in [its] products, such as collagen, amaranth, and nut protein…” In fact, it claims, “[c]ollagen is an incomplete protein as it lacks one of the nine essential amino acids…”

This gives certain products an even lower Protein Digestability Corrected Amino Acid (PDCAA) score “than amino acid content testing alone suggests. Amaranth and pecans typically have PDCAAS scores of approximately .70. Collagen has a PDCAAS score of 0 since it is incomplete.’

Also, foods that make a protein claim must include the percentage of daily value offered. The Purely Elizabeth products do not provide this number on its nutrition facts panels.
