This class action alleges that Publix Super Markets violates state consumer protection laws by marketing its Parmesan cheese as 100% Real” Parmesan cheese when in fact the product contains excessive amounts of a filler called cellulose.
Publix Super Markets is a large super market chain operating mostly in the Southeast. It sells its own private line of food products including cheeses.
The entire “cheese” industry has come under some scrutiny for industry-wide marketing practices. Specifically, some lawsuits have challenged labels that claim to contain “100% Real” cheese but in fact those products contain fillers of some type or another.
Publix is facing similar issues with its 100% Real Parmesan cheese and its 100% Real Parmesan and Romano cheese. The company includes a filer called cellulose in those products. Apparently the company has begun to relabel these products to exclude the 100% Real term, but this lawsuit seeks apparently compensation for those consumers who bought the products already and apparently too some type of injustice relief to require the company to remove similar claims form its web site.
Cellulose by the way is wood pulp. The FDA has deemed it safe for human consumption. So the crazy thing about this lawsuit is that it is perfectly fine to use wood pulp in Parmesan cheese, but arguably the producer can nott call it “100% Real”.
