PotlatchDeltic “Rounding” of Hours Worked FLSA Class Action

The complaint for this class action alleges that workers at PotlatchDeltic Corporation were not properly compensated for all time worked. The complaint claims this is a violation of the Fair Labor Standards Act (FLSA) and the Arkansas Minimum Wage Act (AMWA).

Two classes have been proposed for this action.

The FLSA Class is all hourly workers at PotlatchDeltic’s Warren Facility, between October 16, 2015 and the date of judgment of this action, who were classified as non-exempt from overtime requirements and who are entitled to the types of damages listed in the complaint. 

The AMWA Class is the class of hourly workers who are or were employed by PotlatchDelitic within the relevant time period within the state of Arkansas.

PotlatchDeltic is a timber processing and management company which has milling and processing facilities in Arkansas, Idaho, Michigan, and Minnesota. It employs about fifty workers at its Warren Facility, which mills and processes lumber for sale and shipment to other areas of Arkansas and the US. 

Plaintiff Shetrina McCoy is an hourly employee who is not exempt from overtime rules. She was classified as a machine operator and worked for the company between approximately March 2014 and August 2018.

According to the complaint, McCoy worked long hours as well as many days for the company, as did many other employees. The complaint says that paychecks for her and others showed that they had worked between roughly seventy and ninety hours per week, as well as six or seven days per week. 

However, the complaint alleges that the employees were not paid for all hours that they worked. Employees punched in and out on time clocks, at the beginning and ends of days and for lunch hours, but the complaint claims that when it came time to pay them, the company “rounded” the clocked-in and clocked-out times in favor of the company. The complaint claims that the company also altered times if the workers clocked in early or clocked out late. 

According to the complaint, the workers were therefore not paid for all hours that they actually worked. 

The complaint requests that the workers be paid for all the hours they worked, including overtime premiums for hours over forty each week. It also requests that they be awarded damages as well as reasonable attorneys’ fees and costs and pre- and post-judgment interest.
