Pine-Sol Cleaners Found to Contain Harmful Bacteria Class Action

The Clorox Company makes the popular Pine-Sol cleaning products. However, this class action alleges that the products have contained Pseudomonas aeruginosa, which the complaint describes as “a gram-negative bacterium that causes infections in the blood and lungs and is associated with inhalation and skin ingestion. The complaint alleges that Clorox did not warn consumers of this when they bought the products.

The class for this action is all consumers who bought the products anywhere in the US during the applicable statute of limitations period. Also defined is a New York Subclass, for those in the above class who bought the products in New York.

The products at issue include the following:

  • Clorox Professional Pine-Sol Lemon Fresh Cleaner 144oz

The complaint alleges that Clorox “improperly, deceptively, and misleadingly labeled and marketed” the Pine-Sol products because it did not disclose to consumers that the products “that consumption of the Products may increase the risk of contracting invasive infections.” Companies are supposed to list all active and inactive ingredients of products, but nowhere does the Pine-Sol packaging mention the presence of the bacteria.

Infections from the bacteria, the complaint alleges, can have serious and even life-threatening consequences, particularly those who are immunocompromised. This is particularly bad, the complaint claims, because consumers who use the product are spreading bacteria all over their homes when they have been led to believe they are cleaning the place.

If the bacteria was put into the product on purpose, the complaint alleges it should have been identified on the labeling. If it got into the product by accident, the complaint claims, “it follows that it was due to poor manufacturing processes by either [Clorox] and/or [its] agents.”

The complaint alleges that the company’s advertising and marketing campaign for the product is “false, deceptive, and misleading” and that those who bought the products “lost the entire benefit of their bargain” when the bought a cleaning product that was contaminated with bacteria. It appears that Pine-Sol has recalled the products.
