
The Clorox Company sells cleaning products throughout the country, including Pine-Sol for cleaning floors and other nonporous surfaces. Unfortunately, the complaint for this class action alleges that Pine-Sol products have been (or may be) contaminated by bacteria that can increase users’ risks of getting invasive infections and other injuries, and that this was not disclosing to purchasers on its labels.
The class for this action is all consumers who bought the products in the US during the class period. The products at issue include the following:
- Pine-Sol Multi-Surface Cleaner Lavender Clean, 28oz, 48oz, 60oz
- Pine-Sol Multi-Surface Cleaner Lemon Fresh 28oz, 48oz, 60oz, 175oz
- Pine-Sol Multi-Force Cleaner Lemon Fresh, 100oz
- Pine-Sol Multi-Surface Cleaner Lemon Fresh 2x, 100oz
- Pine-Sol Multi-Surface Cleaner Sparkling Wave® 48oz
- Clorox Professional Pine-Sol Lemon Fresh Cleaner, 144oz
- Clorox Pine-Sol Lavender Clean All Purposes Cleaner, 144oz
- CloroxPro Pine-Sol Lemon Fresh All Purpose Cleaner, 144oz
- CloroxPro Pine-Sol Orange Energy ® All Purposes Cleaner, 144oz
- CloroxPro Pine-Sol Sparkling Wave All Purpose Cleaner, 144oz.
The bacteria found in the products, the complaint alleges, is Pseudomonas aeruginosa, the complaint alleges, “which could lead to serious and life-threatening adverse health consequences. The risk of serious infection is also particularly concerning for immunocompromised individuals who are highly susceptible to life threatening diseases and even death from Pseudomonas aeruginosa.”
Also concerning, the complaint claims, is that the “bacteria in the Products can survive on inanimate surfaces for months and can be transmitted through airborne exposure and contact with the skin. Consequently, the bacteria in the Products can infect people if the person is close to the applied surface of if the person touches the applied surface.” Even inhaling or being exposed to the bacteria via the products may lead to sickness or even death.
The complaint alleges that the advertising for the products is false, deceptive, and misleading, because it did not disclose anywhere on the packaging or labeling that they contained, or may contain, dangerous bacteria. Consumers believed they were purchasing a cleaning product, the complaint claims, and would not have bought a product known to be contaminated with harmful bacteria.
Consumers, the complaint claims, “paid a price premium for the Products based upon Defendant’s health-conscious marketing and advertising campaign” and so were injured by not being warned about the bacteria anywhere on the labels.
Clorox is an old and leading name in household products, the complaint says, and has now recalled the products. But the complaint alleges that this is more evidence that the presence of Pseudomonas aeruginosa is concerning.
