
Petco is known as a place where consumers can buy supplies for their dogs and other animals and where they can have their animals groomed or trained. This class action brings suit against Petco Animal Supplies, Inc. and Petco Animal Supplies Stores, Inc., alleging labor violations in the companies’ treatment of those who work for them as hourly “guest experience specialists,” sale associates, dog trainers, and other manual labor roles. Specifically, the complaint alleges that the companies have not paid these workers their wages within seven calendar days after the end of the week in which the wages were earned.
The class for this action is all persons who work or have worked as manual workers for Petco Animal Supplies, Inc. or Petco Animal Supplies Stores, Inc. in New York between August 5, 2014 and the date of final judgement in this case.
The plaintiff in this case, Aishaya Caul, worked for Petco in New York as a guest experience specialist from around October 12, 2018 to around June 30, 2020. The store she worked in is located on Gateway Drive in Brooklyn. Caul qualifies as a “covered employee” under New York Labor Law (NYLL).
More than twenty-five percent of her duties were physical. They included the following tasks:
- Stocking shelves
- Sweeping and mopping floors
- Bagging purchases for customers
- Carrying items for customers
- Standing for long periods of time
The complaint alleges, “Despite regularly spending more than twenty-five percent of her shift performing these physical tasks, Caul has been compensated by [Petco] on a bi-weekly basis.” For example, her pay for the period of January 27 to February 9, 2019 was paid to her on February 15, 2019. This means that she was not paid her wages for the week of January 27 to February 2, 2019 by February 9, 2019, as required by NYLL.
According to the complaint, Petco also failed to give her wage statements specifying the number of hours she’d worked per week. This is a violation of the NYLL requirement that employers provide hourly workers with accurate wage statements.
The counts include failure to pay timely wages and failure to provide accurate wage statements.
The complaint asks for liquidated damages, statutory penalties of $250 for each workday that Petco failed to give Caul or the other class members accurate wage statements (a total of $5,000 each), pre- and post-judgment interest, attorneys’ fees and costs of this action, plus “[s]uch other relief as this Court shall deem just and proper.”
