Nordstrom and Paige “Luxury” Jeans Puckering Defect Class Action

Paige, LLC makes jeans, including a collection of “luxury” designer denim jeans that it sells both in its own stores and through other retailers, including Nordstrom, Inc. Although the jeans are sold as a “luxury” items at high prices, the complaint for this class action alleges that the jeans are either defective manufactured or defectively designed, because the material tends to pucker or warp, creating lumps or ripples in the jeans, which make them unsightly and unwearable.

The class for this action is all persons or entities in the US who bought one or more pairs of Paige jeans at retail from a physical retail stores operated by either Paige or Nordstrom, between December 22, 2018 and the date of final disposition of this case.

The Paige jeans are supposed to be high-quality, luxury merchandise, the complaint alleges, with many pairs selling for more than $200 each. To justify the prices, the complaint alleges, the companies tout their quality and luxury status.

In particular, the complaint cites a hangtag saying that “Paige redefines the standards of luxury…” The complaint quotes the hangtag as saying that “this fabric features an innovative formula that yields luxuriously soft denim that won’t stretch out.” This tag is attached to the jeans in the stores, where customers are presumably intended to see them and conclude that if they buy the jeans, they will be getting superior fabric.

However, the jeans may not in fact be made with superior fabric, the complaint alleges, and “quickly become worthless for their intended purpose as fashionable clothing,” because of the defect. The complaint alleges that it leads them to bubble up in small puckers and bulges, “creating ripples across the surface of the jeans which in turn renders the jeans unsightly, aesthetically unappealing, and ultimately useless…”

The puckering occurs no matter how they are laundered, the complaint claims, so that the puckering cannot be blamed on the consumers who bought the jeans.

This class action is brought by four plaintiffs from various states, all of whom bought the Paige jeans. Two claim never to have put the jeans in a dryer; one claims to have put some pairs in but not others. However, the complaint alleges that all four have experienced the puckering of the fabric, sometimes within months of purchase or with relatively little wear.

Among other things, the complaint alleges that the companies have breached the implied warranty of merchantability and asks that they disgorge all profits from the jeans and pay restitution to the members of the class.
