Naturelo Magnesium Supplement Amount of Magnesium Class Action

Naturelo Premium Supplments, LLC offers what it calls a “premium” magnesium product, which it claims provides 200 mg of elemental magnesium per capsule. But the complaint for this class action alleges that it is physically impossible for the capsules it uses to contain this amount and that Naturelo engages in deceptive supplement labeling.

A class and a subclass are proposed for this action:

  • The Nationwide Class is all persons in the US who, between February 24, 2018 and February 24, 2022, bought Naturelo’s Magnesium Supplements.
  • The California Subclass is all persons living in California who, February 24, 2018 and February 24, 2022, bought Naturelo’s Magnesium Supplements.

Page 6 shows an image of the front label of the product, with the word “Magnesium” written in a large font along with the “200 mg per capsule” claim in a smaller font. Page 7 shows an image of the back label, which bears a Supplement Facts panel that repeats the “200 mg” claim, adds that this is 48% of the recommended Daily Value of magnesium, and promises 30 mg of a “Magnesium-Rich Plants Blend.”

Both the front and back claim that the magnesium is in the form of Magnesium glycinate chelate.

However, the complaint quotes a government fact sheet as saying, “The Supplement Facts panel on a dietary supplement label declares the amount of elemental magnesium in the product, not the weight of the entire magnesium-containing compound.”

However, the complaint alleges, “It is impossible for one capsule of [Naturelo’s] Magnesium Supplement to contain the advertised and warranted 200 mg of elemental magnesium in light of (1) the amount of elemental magnesium contained in magnesium glycinate chelate and (2) the maximum capacity of the capsules [Naturelo] uses for its Magnesium Supplements.”

The complaint identifies the capsules as size 00 and claims, “On the highest end of the density spectrum, a size 00 capsule can contain 1,092 mg of powder with a density of 1.2 g/ml…”

It then asserts that “magnesium glycinate contains only 14.1% elemental magnesium by mass. Accordingly, approximately 1.418 mg of magnesium glycinate is needed to obtain 200 mg of elemental magnesium.” Size 00 capsules, it alleges, cannot fit 1,418 mg of powder, no matter how dense the powder is.

On top of that, the label shows that the supplements contain other inactive ingredients, such as “Rice Flour (Brown)” and “Rice Bran Extract” which it claims also lowers the amount of magnesium the capsules can contain.

The complaint alleges that Naturelo’s representations about its magnesium supplement are misbranded, and unlawful under both federal and state laws.

The counts include breaches of warranties, fraudulent concealment, and violations of California state laws.
