Nationwide Health Advisors Unwanted Telemarketing Calls TCPA Class Action

A company called Donisi Jax, Inc., doing business as Nationwide Health Advisors, has violated the Telephone Consumer Protection Act (TCPA), says the complaint for this class action. According to the complaint, the company claims to be a broker of health insurance plans, and it has made unwanted calls to cell phones and failed to maintain an internal Do Not Call list.

The class for this action is

  • All persons in the US
  • Who received more than one telemarketing call from the defendant or on its behalf,
  • On a cellular or residential telephone line,
  • More than thirty days after asking not to receive further calls,
  • In any twelve-month period between June 21, 2014 and the trial of this case.

The TCPA does not allow companies “to make any call … using an automatic telephone dialing system or an artificial or prerecorded voice … to any telephone number assigned to a … cellular telephone service” except for emergency purposes or where the owner of the cell phone has given prior express written consent to receive such calls.

The law also requires that companies who do telemarketing keep internal Do Not Call lists so that when people ask them not to call any more, they do not make any further calls to them.

Plaintiff Carol Missry saw a post on social media advertising health insurance through Nationwide Health Advisors, the complaint says, and decided to call the company to research possible health insurance for her husband, Hyman. After speaking with Nationwide, the complaint says, she decided she was not interested in what they were offering.

However, sometime in March 2018, the couple began receiving telemarketing calls from Nationwide. On or about March 19, 2018, the complaint says, Missry spoke to a representative of the company and asked them to stop calling her. However, the calls did not stop.

Missry then set up a customized automatic reply for the company that she could play each time it called her. Still, the complaint says, she received numerous calls through April 20, 2018 and dozens of calls after that.

The complaint claims that the company uses an automated dialing system to make the calls and/or an artificial or prerecorded voice.
